as to a suitable surveyor, there will be no necessity
to delay matters by referring the question to this country), and the respective values of the land
Burrendered by the Colonial Government and the War
Department set off one against the other, it being
understood

(a) that, should the land required by the War
Department exceed in value that surrendered to
the Colonial Government, the Department must pay
the excess value in cash or only receive
Colonial land up to the value of that surrendered.
If the value of the land surrendered is in
excess, then that exceas is to be devoted to
paying for any other land that may be required
by the War Department.
(b)
that the value of the land required by the
Hong Kong and Whampoa Dock Co., is to be the
price paid by that Company to the Colonial
Government, less a deduction (hereafter defined)
on account of the small area of military
reserve land included therein.
(c) that the Colonial Office admits that the
War Department has rights of Militery Reserve
over all the land at Kowloon involved in these
exchanges (except that at the Water Police
