With reference to Lord Knutsford's Des-

patch No. 96 of the 29th. May, 1890, concerning the moluments

August 1902. September 71902.

of the Attorney-General, I have the honour to transmit to you

the enclosed copy of 2 minutes from Sir Henry S. Berkeley

requesting that the Attorney-General may be permitted to re-

ceive such Counsel's fees as may be from time to time awarded

by the Court in cases in which he appears as Counsel on be-

half of the Crown!.

Notwithstanding the ruling of Lord —

Knutsford, the practice at present in this Colony is that,

when the Attorney-General appears in any case, Counsel's fees

are included in the Crown Solicitor's bill of costs, the

amount of the fees allowed by the Registrar on taxation vary-

ing in accordance with the importance of the case, the labour

entailed on Counsel in preparing his argument and the time

occupied in Court. When the amount allowed on Counsel's fees

is recovered it is paid by the Crown Soliciter into the

Treasury.
