In the meantime, as it is understood that the Record has been forwarded by the Appellants to England, I have to request you to be good enough to place the Record forwarded herewith in the hands of your Legal Advisers, with instructions to retain Counsel to appear before the Privy Council, and to argue the question whether an appeal to their Lordships from the Full Court here is competent.

I desire to point out that the present Chief Justice was not advising the Officer Administering the Government as Attorney-General at the time that Major-General Black awarded $15,000 by way of compensation to the Appellants.
