was appld MLA as he shall hold the office for "so long" of Bapt. Supt. of Police in that Colony Mr Brewin (37124/07) was apptd. provisional member during Ms May's absence on leave. Governor this provisional appt.

But no permanent appt can be made without a fresh warrant, which seems to produce rather an anomalous result, since there is nothing to prevent a person from holding office for an indefinite period.

am. ask you whom he recommends for the permt. seat in the L. C. in place of Mr May.

Mr Badeley was apptd. a provisional member (24417/02) in place of Brewin when the latter came on leave, & Dr Black has been apptd. in place of Badeley who has retired.

[N.B. Mr B. need not have revoked his appt. under last sentence of art. 14 of the Instructions of 19 Jan '88.

The question is, when Mr May became Col. Sec. & the warrant apptg him M. L. C. thereby ceased to have effect, was there a vacant seat in the Ccl. to which it was competent for the Gov to appt provisionally? I think it was all right owing to the words "vacant" in art 14 of the further Instructions of Jan '88. If so, no action is required by me in regard to his appt.

1895 authorised his appt only for so long as he held the offices of Capt Supt of Police, & I do not think any question can be raised as to whether his seat became vacant the moment he became entitled to an Ex-officio seat as Colonial Secretary.
