or about the month of March 1901 your Petitioner for the first time discovered that under Rule 153 of the Colonial Office Regulations he was entitled to have the passages of his Wife and Child (as well as his own) secured and paid for by the Crown Agents for the Colonies and he accordingly applied to the Government of Hongkong for repayment of the amount which he had himself paid for the passages of his Wife and child. The said Government thereupon paid to him the sum of $350.97 to cover the cost of the passages of his Wife and child from England.

On the 14th day of May 1901 the head of his department called upon your Petitioner to refund the said sum of $350.97 alleging that being under a temporary Agreement your Petitioner was not entitled to receive it and notwithstanding the said Rule of the Colonial Office Regulations (which your Petitioner submits applies to his appointment) your Petitioner was forced to repay the said sum and he paid it to the Government under protest on the 24th day of June 1901.

Your Petitioner has discovered that several Civil Servants of the Government who have arrived in Hongkong under Agreements precisely similar to that under which your Petitioner came out to the Colony have (both before and after the date of his Agreement) been allowed in addition to their own passages the passages of their
