The question whether certain Regulations made under the Order of 189... would or would not be ultra vires appears to me now to be an academic question because the Ordinance expressly enables these particular regulations to be made.
I have the honour to transmit to you the enclosed Petition signed by certain Merchants and Shipping Agents in this Colony regarding some provisions of the Merchant Shipping Consolidation Ordinance, 1899, as amended by an Ordinance of 1901.

2. The petitioners pray that Section 23 of the Merchant Shipping Consolidation Ordinance of 1899 as amended by Section 24 of the Amending Ordinance of 1901, may not be allowed to come into force in its present form, and that No. 16 of the proposed new Regulations may also be disallowed. The petitioners more particularly ask that the amended Section and the proposed new regulation should be modified so as to limit the liability of owners and agents of vessels, in respect of the costs and expenses of Medical treatment, to persons on the ship's articles.
3. This petition has received my careful attention and that of the Executive Council. With the exception of the two Unofficial Members of that Council it was unanimously advised that the Government should not recommend the alterations contemplated by the Petitioners.
