Seeing that Mr. Peak had been dismissed under the Prison Regulations, I deemed it advisable, instead of suspending him, to inform him at once that the Executive Council had advised that the charge against him had been proved, and that he was dismissed accordingly.

I may add that this man had been previously fined $10 for being drunk. I attach a copy of an extract from the punishment book. The power of dismissal is clearly given under the Prison Rules passed by the Legislative Council and approved by you.

4. I would suggest that in the engagement of Warders in future it should be distinctly stated that they are engaged under the terms of the approved Prison Regulations, which are necessary for the preservation of discipline among a body of armed Warders.
