With reference to your despatch No. 286 of the 19th December, 1899, I have the honour to transmit for your information the enclosed copy of a letter from the Superintendent, Victoria Gaol, recommending the dismissal of Hospital Warder Job Peak for being intoxicated while on duty on the night of the 28th June.

2. On Mr May's recommendation, I dismissed Warder Peak, acting under the powers given me by Prison Rule No.104(2) and overlooking the fact that, for reasons which I cannot understand, Mr Peak was appointed not under the Prison Rules of this Colony but under the Colonial Office Regulations. In this connection I refer you especially to paragraph 4 of the letter addressed by Mr C.P. Lucas to Mr Peak No.33386/99 of the 5th December, 1899.

3. I enclose for your information a copy of the correspondence with Mr Peak which ensued and which resulted in the trial of Mr Peak before Executive Council on the 1st instant. I enclose a copy of the evidence as recorded by the Acting Attorney General at the trial. The advice of Executive Council was that the dismissal of Mr Peak on the 2nd July should stand.
