We have pleasure in acknowledging receipt of your communication of the 25th instant, enclosing Draft of a Bill entitled "An Ordinance for authorizing the construction of a Tramway within the Colony of Hongkong", and in reply beg to forward the following observation on a point which affects this Company.
"Clause 19", as it stands, empowers the Tramway Company, subject to certain restrictions, "to alter the position of any mains or pipes for supply of gas or water, or any tubes, wires, standards, poles or apparatus for telegraphic, telephonic, electric lighting or any other purposes", whenever it appears expedient to the Tramway Company for their own protection or convenience, or whenever the owners of such pipes, standards, wires, &c. give notice to the Tramway Co., that they consider the projected Tramway works will interfere with their respective services.
In no place is it mentioned or laid down that the "Department Company persons or person" interested shall have the first option of making, at the Tramway Company's expense, such changes in the pipes, standards, wires, &c., which are affected.
