3. and with our new aids In the treaty between France and China of 9th June, 1885, Art. 7 recites in the second paragraph, "When the Chinese Government shall have decided to construct railways, it is agreed that she shall have recourse to French industry, and the Government of the Republic shall afford every facility for procuring in France the staff that may be required." It is, moreover, understood that this Clause shall not be looked upon as constituting an exclusive privilege in favour of France. So this article, the last sentence would appear to modify materially the first portion of the paragraph.
44. But Article No. 5 in the additional convention between France and China, signed on the 20th May, 1895, goes further and provides that "It is understood that China will address itself, in the first instance, to French Commerce and Engineers, for the Exploitation of its mines in the Provinces of Yunnan, Kwang si and Kwang tung, the Exploitation remaining otherwise subject to the rules and edicts by the Imperial Government which affects National industry".
5. Still Even this would appear to be governed by Article 54 of the Treaty of Tientsin of 1858, which secures equal rights to British Subjects.
