I am directed by the Board of Trade to call
your attention to paragraph 11 of the Regulations for the Exa-
mination of Masters and Mates in the Mercantile Marine (1898
edition) which relates to the Sight Tests to be undergone by
all candidates for Certificates of Competency, and provides
inter alia, that if a candidate fails to pass any of the three
tests, a note of the fact of his having done so will be written
across the face of the certificate he possesses, if he is al-
ready in possession of a certificate, before it is returned
to him.
I am to state that the Board of Trade have had
under consideration the verdict in an action brought by Mr.
E.L. St.J. Coleman against the Marine Board of Victoria, in which
the Plaintiff was awarded two hundred pounds damages against
the defendants, who had caused his certificate to be endorsed
with a statement to the effect that he had failed in the Form
Vision Test.
The Board of Trade are advised that they have
no statutory power to endorse the certificate already in the
