** It has been evident for some tive past that the Hong Kong Code of Civil Procedure, which has now been in force for

more than 27 years, needed to be revised and brought up to date.

This task was undertaken by Sir J. Carrington the Chief Justice

with the sanction of the Governor and the Secretary of State.

He prepared a draft Code while on leave in England and got it

painted, and copies arrived in the Colony in April last.

These copies were distributed among the members of the

legal profession for their consideration,and a Committee was

formed last July for the purpose of examining, revising, and set-

tling the draft.

The Committee consisted of the Chief Justice, the Act-

ing Puisne Judge, two members of the Bar (Mr. Pollock and Mr.

Sharp) and two Solicitors (Mr. V. H. Deacon and Mr. J. F. Reece).

At the same time, all the members of the profession were invited

to send in to the Committee written suggestions for the improve-

ment of the Draft, and the work of Revision was thoroughly and

carefully done by this Committee.

The Bill was then introduced by me into the Legislative

ouncil and, when it had been read a second time, it was referred

to the Standing Law Committee of which I was the Chairman. This *

mmittee, accordingly, went through the Code again before it was

ad a third time, and I have no doubt that it will be found well

dapted to the requirements of modern practice and suited to the

eeds of the Colony.

A Statement of Clain and a Statement of Defence are now

substituted for the Petition and Answer of the 1873 Code, and

The practice, generally, has been brought into line with that at

present prevailing in England, so far as has been deemed prac--

Iticable.

The Code is to come into operation on the 1st day of

uly next, that is to say upon the same date as the Civil Proce-

ure (Statutes Repeal) Ordinance, 1901, The Trustee Ordinance, 901, and the Law Amendment Ordinance, 1901.
