Enclosure 6.

. Y

Hoa.Colonial Secretary.

The Treasurer, Crown Solicitor and i nave coaferred together as to whether refund or passage money could be enforced : -

Bagg may argue tous: The letter 18034 offered ne

on behalf of Mr. Chamberlain the specific post of Wardmaster in the

Kannedy Towa Hospital (which I will call post A).

I accepted that post by telegram on Bord.Juae, 1900.

1 taea entered into an agreement with the Crow Agents

to proceed to dougkong aad, among other things, to refund my passage Money in I was dismissed from that appointment. (Post A).

Faen I arrived, ay cost A was not given to us but i

Kas appointed warduaster in the Government Medical Department "90

the conditions named in letter 16084", ie. i was appolated to post B on certain condition, one of which was that if i was dismissed from post A i would nave to retura passage money. In other words ne

might argue he accepted io Bagland Post "A", on certain conditions

but when be got out here, he was locally appointed to Post E witn

nis consent (17 toat is decided against bia) arter the pas-ape was

finished.

it aight of course be contended on the other side,

that the conditions" referred to, meant conditions "Mutatis

mutandis". But in all tas circunstances we think it doubtful

whether the passage money could be recovered. In any case toe

original agreement is with the Crown Ageats and act is nongkong.

we would suggest that the Crown Agents' Agreement as to refunds

night, wito advantage, be so framed as to include any Civil Service

appointment held by an officer withio * years.

(Signed) ...Goodnen,

12/10/00.
