I have the honour to acknowledge the receipt of
your despatch No.97 of the 10th.ultimo, enclosing copies of
correspondence with Messrs. C. and E. Morton relating to an
alleged imitation of their label, and to state in reply that
this matter had previously been brought to my notice in a
letter, a copy of which I enclose,from: Messrs. Morton to the
Acting Colonial Secretary.

The Governor in Council has power under the
: Trade-marks Ordinance (No.18.of 1898) to cancel the registra-
tion of a mark on such grounds as he may consider sufficient;
: but it is obvious that the mere allegations contained in the
: letter of Messrs. Morton could not be considered sufficient
grounds for such action, and accordingly I caused the letter
or which I enclose a copy to be addressed to them.
