Extracts from opinion of Mr.J.J.Francis, Q.C.,given in 1893.
"I have carefully studied (1) Ordinance 6
of 1883 as amended (2) The Order-in-Council and Government
Notifications thereanent (3) the Prospectus and Articles of
Association of the Tramways Company of July 1884 (4) the
recent correspondence with the Government on the subject of
the proposed transfer to Mr.Kirk of the rights of the Pro-
moters in respect of Tramways Nos.1,2,3,4, and 5 and (5)all
other papers bearing on the subject within my reach, and I
am of opinion:
1. The rights and privileges conferred by
The Tramways Ordinance 1885 on the Promoters are still
valid and subsisting.
2. These rights and privileges are now vested
in and exerciable by the three Promoters now living and by
no other persons. I cannot find that any Transfer or Assign-
ment of any of these rights and privileges has ever been
made to any person or persons, company or corporation except
in respect of Tramway No.6 (i.e.the Peak Line) A Company
was formed and registered in July 1884 to take over the
rights
