2. I have to call your attention to the terms of the Warrant for Mr. May's appointment to an official seat on the Legislative Council, which defined the period of his absence for so long as he shall hold his office of Captain Superintendent of Police"
3. It appears that Mr. May does not cease to hold the office of Captain Superintendent of Police, in consequence of this appointment as Colonial Secretary. His seat is therefore not ipso facto vacated thereby.
4. In my telegram of the 5th instant, I informed you to the above effect, and added that Mr. May should formally resign the official seat to which he was appointed by Warrant. The conditions laid down in Article 3 of the Instructions of 19 July, 1885 will then be fulfilled.
You can then proceed to make arrangements for filling the seat vacated thereby.
