The question has arisen owing to a request by Sun Sik man for permission to erect a pier foreshore in this Bay, which involves a number of subsidiary points of title; these are dealt with at some length in the enclosures attached to the Governor's despatch, but do not materially affect the main subject of this reference. It is probable, however, that Yun Sik man's request is only the forerunner of other applications of a similar kind, and as there is a divergence of opinion as to the rights of His Majesty's Government under the Convention, notably in Mirs. Bay and Deep Bay, it seems desirable that an authoritative decision should be obtained for the guidance of the Government of Hongkong.

3. The clause in the Convention dealing with the subject will be found on p. 2 of the accompanying print of the document, which runs as follows: "The area leased to Great Britain, as shown in the annexed map, includes the waters of Mirs. Bay and Deep Bay, but it is agreed that Chinese vessels of war..."
