Refer to Attorney General for advice as to the position of the trustees. They evidently feel that they are bound by the terms of their appointment to make this Mount Davis road or none. Are they so bound? If so, the matter must lie over ultimately when the sum has accumulated to a large amount; probably it will be dealt with by Legislation.

Government notification No.97 of 17th March 1897 contains the appointment of the Jubilee Committee of 1897. After referring to this notification; to the report in the Daily Press of 27th April 1897 of the meeting of the Committee with special reference to No.3 of Mr. Whitehead's resolutions, and to the heading which was affixed to the lists asking for subscriptions (see 1 in C.O. 1098/97 herewith) please advise how far the position taken up by the Committee holds good viz:- (1) that they are trustees of the money subscribed.
