The evidence could probably not be strong enough to induce a Jury to send these men to prison especially as each case would have to be tried by itself and the Lists and Books found at East Street would not even be admitted in evidence at all unless asked for by defendant's Counsel.
The identification, the lists, the statement of the man who actually paid the men, the verification afforded by the Beats, in my opinion justify dismissal.
