With regard to Tangham, the same thing was said to him. He was not told who judge of the truth. I remember three detectives who were represented by Mr Evans. They were told that, if they would tell the truth, they would not be banished. None of them gave information about this case. They were banished. With regard to Sam You, who was a convicted man, he was told that, if he would make a true and full disclosure, his case would be taken into the consideration of the Government, if he desired any mitigation of his punishment. He has passed the period for hard labour. The law in case of prisoners sentenced to banishment was that those under banishment warrants and were sentenced to more than six months, if passed by the Surgeon, goes to separate employment. [Mr Robinson refers to No. 28 of the Prison Rules] Sam You has been put to No. 1 hard labour. He is not at it now – fucking oa kum, which is No. 2 hard labour.
He was stopped hard labour as soon as I received a reply from the Government authorising the Crown Solicitor and myself to make to him the communication that I have spoken of. This taking off was two or three days after his conviction, and before he gave evidence at the Police Court. The men under banishment warrants are special prisoners at the gaol under the discretion of the Captain Superintendent of Police. [Mr Robinson refers to Ordinance 10 of 1884 as amended by Ordinance 4 of 1885.] They were detained at the gaol because there was no other proper place in which to detain them. I deny that I have acted illegally in keeping them in custody.
