3. His Excellency the Governor stated that the meeting had been convened in accordance with Colonial Office Regulation No 85 to consider the question of the formal suspension from office of Mr C. O. Frank, late of the Registrar General's Office, and of Inspector Hore, Inspector of Nuisances in the Sanitary Department, both of whom were charged with corruption and had been interdicted from the exercise of the powers and functions of their respective offices under Colonial Office Regulation No 85.

The procedure prescribed by Colonial Office Regulations Nos 84 and 85 had been duly followed and Inspector Hore had appeared before the Council to defend orally against the following charges:

"That while an Inspector of Nuisances in the employ of the Sanitary Board of Hong Kong, he corruptly and in breach of his duty as an officer employed by the Government of Hong Kong from November 1895 until July 1907 received money from the keeper of an illegal gambling house at No. 2 Wa Lane in Victoria, Hong Kong, such money being obtained from one Leung Yat Po, a person in the employ of the said Sanitary Board and acting as Interpreter to the Sanitary Board, being paid to his credit and on his account, with his knowledge and consent and on condition that he would not report the existence of the said illegal gambling house to the Government."
