The Plaintiff's case rests on the point whether the Plaintiff can or cannot prove the illegitimacy of Matthew Soutor Falconer, the reputed son of Matthew and Marion (or Marianne) Falconer. If he fail to prove this issue the Plaintiff has no title to interfere in the administration of the Estate of Matthew Falconer, deceased. If he succeed he has the rights of the sole next of kin of Matthew Falconer.

The evidence of illegitimacy rests on the rather dubious statement of the Plaintiff as expressed in his Petition filed 19th August, '...'(1) and (2) on the statement of Mrs. B. Galome that Marion (Marianne) Falconer so called once admitted to her on the occasion of wanting to draw money out of a Bank that she had never been married to the said Matthew Falconer. If the Plaintiff succeed he has the rights of the sole next of kin of the said Matthew Falconer.

I have stated the grounds favourable to the Plaintiff's contention, he and his wife have been advised that further evidence must be

obtained and the Plaintiff has stated that it was possible that information might be attained from a Bank in Chicago at which money was placed to the credit of the said Matthew Falconer.
