I submit that requiring him to enter into bond to serve a stated number of years is in effect a negativing of his request that the leave should be counted as special leave with pay not to be deducted from leave to be earned by future service.
The proposed leave would be 3½ months in excess of that grantable under the Col. Reg. & it would be more in accordance with rules & precedents to lay down that if he takes that excess leave now he must be regarded as “advance leave” to be worked off by future service, he must therefore bind himself to serve at least long enough to work that off.
Earned leave: 6 x 3½ months = 21 months, approximately 2 years;
but I do not see that we have any right to demand that he should bind himself to serve as long as 5 years as proposed by the Governor.
Proceed as proposed by Mr. A, adding as in last paragraph of your despatch & inform Agents &c.
