402 In answer to the marginal notes, I think no flogging of any kind, unless awarded by a court, should be inflicted without the Governor's authority.
This is because the "power has been abused at Hongkong" & I believe this to be the best way of checking the abuse. It has, moreover, the great merit of making the Governor directly responsible.
