and 571, and building leases were issued in respect of them.

In October 1889 the lessee gave notice to the Surveyor General of his intention to commence building operations, but permission to build was withheld by the Government owing to objections on the part of the Military Authorities, the land in question being within the Military Reserve.

The application was renewed in January 1890 and again refused on the same grounds, objections on the part of the Military Authorities to the erection of buildings on these sites were subsequently withdrawn, but the lessee was not informed of this, and the application to be allowed to build was not renewed again.

In March last the lessee - Dr Gerlach - applied, on the grounds above stated, for a refund of the brown rents
