(4) For otvicus reasms it is always the custon to request

the attendance of the un-official Justice for the week when required

to hear a case which is of too serious a nature for the Superintendent

to dispose of and I think it highly protable that the Justices, most

of whom are business gentlenen, would object to be called upon a3

frequently as it would be necessary to award a punishment of perhaps

A strokes.

With reference to paragraph 2 of 0.0.Despatch No. 47

of 139 I do not know to what changes in the circumstances of the

case since the existing rule was sanctioned the Secretary of State

refers. That whipping is necesзury here when it would not te in an

English Prison is I sutnit shown by the fact that each Superintendent

bas resorted to it.

I attach a tatie showing the nunter of whippings award-

ed by the several Superintendents for some years tack. In 1394 the

Medical Officer reports that 203 floggings took place in the Gaol tut

of that number only 140 were awarded to my orier and they were chiefly

for refusing to latcur. Twelve cases were beard in conjunction with
