should draw their half pay at the reduced rate. The Secretary of State has stated that he has adopted 14 per cent as the basis because $1/4 of 3/8 is rather more than $100 : 4/2. This principle is in the rule applied to new appointments to the service and to future promotions to any office that received at least 14 per cent increase - and from its silence respecting other officers, I submit the rule applies to them only.

The object was that there should not be an undue increase in the rate of half pay, but it was not meant to reduce the half pay or pension of any office - thus although I drew my half pay as Registrar at the rate of 4/- per diem, I received £2048 instead of the commuted amount.

Whereas if the rule be applied to an Acting Judge, there would be a reduction; since $8400 at 4/2 would not be equal to £8160 at the reduced rate, and in the case of a Registrar there would be a greater difference.

I confidently submit that this is not a privilege or personal allowance but one attached to the office and depends solely on whether the salary of that office has been increased by at least 14 per cent or not.

I further submit that the wording of the despatch is clearly in my favour and supports my case.
