by the directions of an ... as Chief Justice, the authority of the two previous Judges and the directions of His Excellency to the Officer Administering the Government I as Registrar of the Supreme Court was justified in retaining them for my guidance since the receipt of the communication referred to at the commencement of this letter. All fees received in Admiralty ... have been kept separate pending final decision of His Lordship the Secretary of State.

There is however another aspect of the case which with all deference I wish to submit and that is the legal ... Under Section 16 of the Imperial Act, sub-sec. 3 supplemented by Paragraph 47 of a Circular headed "Colonial Office" and dated 20th September 1890 and signed by the Secretary of State it appears to me that until new rules were made the old table of fees were to prevail. If however the views now entertained by His Lordship are to prevail, the difficulty referred to in paragraph 47 of the Circular will arise and therefore I suggest that the paragraph was inserted to meet the difficulty and does not imply that the old rules have been abrogated.

These are the reasons I would wish His Excellency to refer to His Lordship the Secretary of State for the purpose of inducing His Lordship to reconsider his decision as to the refund of the Registrar's fees.
