III. I claim the restitution of the amounts of Crown rent demanded upon the land resumed, with interest from the dates of the several payments.

IV. I claim the right to use, during the currency of my Crown Leases, the Street, to the South of my lots from its Eastern corner to the middle of Inland Lot No. 673, to which point it has been made, and is now open, as an easement which has been enjoyed by the Crown Lessees for nearly thirty years. The several lots being described in the Crown Leases as "bounded on the South by a Public Street."

The cost to me of the land, up to the date of resumption, was $1.57 per foot, or for 9,150

Add to this the depreciation of remaining 13,350

feet at 50 cents per foot, viz.:

The other lots in the same line, my property, or held by me in trust, are depreciated in the same manner by the non-completion of the Street, viz.: Inland Lot 673.

Without prejudice, I am willing to accept $20,000 cash in full satisfaction, and to withdraw all further claims in reference to the resumption of portion of Inland Lot No. 671, and the non-completion of Hill Street to the water side; or if it be preferred, I will accept in exchange, a grant of the adjoining Slaughter House Lot, of approximately equal area to the land resumed, at like proportioned Crown rent, so soon as it shall be at the disposal of the Government by the erection of the contempleted new building at Belcher's Bay.

If possession be not given before 31st of December 1891, interest to be paid at the rate of $1,000 per annum until possession is given.

Should the Government deem it inconvenient to entertain this proposal, then I am willing to accept in full satisfaction, as above, a grant of ground upon the South side of Hill Street, as marked upon the plan herewith, and thereon colored pink. The Crown rent upon Inland Lot No. 671 to be reduced in proportion to the area resumed, from the date of resumption, and the sums overpaid to be returned with interest. The Crown rent upon the new grant to be assessed at the same rate as Inland Lot No. 834 adjoining.
