You now request that you be appointed to serve on the Board on the condition that you are allowed to retain the fee. His Excellency can only presume that both the Secretary of State and the Governor of this colony are aware of the provisions of the law, when they recommended to the Legislature that the salary of the Assistant Harbour Master should be increased on the condition that he should act as a member of the Board without deriving the benefit of any fees, which were to be paid into the Treasury.

It would therefore be found out that to grant the request now made by you, would neither be to follow the instructions of the Secretary of State, nor fair towards the Legislative Council of this colony, inasmuch as...
