authorizes burials in the Cemeteries in the Schedule mentioned, I am informed they have not been, heretofore, specially authorized under any Ordinance, although it was never intended by the Government to prevent burials in these cemeteries. As penalties under the Public Health Act are recovered at the suit of the Secretary to the Sanitary Board (See section 83 of No.24 of 1887) who will certainly take no proceedings for penalties in the case of past burials (if any) in the cemeteries mentioned, I have not thought it necessary to add any clause preventing such proceedings from being taken.
