5. In the 7th paragraph Mr Brown refers to the fact of the Surveyor General not being a Member of the Executive Council, to which he says such officer has belonged from the early days of the Colony.

I do not find that this has been the case. Sir Arthur Kennedy in his Public Despatch No. 100 of the 8th of June 1876, and in a Confidential despatch of the same date, drew Lord Carnarvon's attention to the then Constitution of the Executive Council, and Lord Carnarvon in his despatch No. 153 of the 18th of September 1876 stated that in view of meeting the difficulty referred to by Sir Arthur Kennedy he proposed to appoint Mr Price, who was then Surveyor General, as an additional member of the Executive Council. Mr Brown is incorrect in stating therefore that from the early days of the Colony the Surveyor General has been a Member of the Executive Council.
