It appears from section 3 of Ordinance 4 of 1857 that, in this Colony, in all proceedings where costs would have been recoverable by or from private parties they are recoverable by or from the Crown. Occasions may arise when I may successfully conduct some action, for the Government and recover costs, and I respectfully submit that, in the circumstances, I should in such case be entitled to retain my Commission as Counsel's fees. Moreover, my commission as Admiralty & Advocate is distinct from my commission as Attorney General, and I submit that I should be allowed to retain any fees I may earn.

It is hard, after respectfully submitting that an Officer has incurred more than £100, out of pocket, travelling expenses, to add an additional term to the conditions of his service, diminishing the emoluments he naturally had assumed appertained to his Office.

I should be glad if His Excellency would kindly forward a copy of my letter of 24th March, 1890, and of this letter to the Right Honourable The Secretary of State with such remarks, if any, as His Excellency may consider proper.
