be its effect upon the
purchase price.
6. Lord Huntford is
in care of any proposals for selling military property, except that the Colony have offered to buy the
North Barracks at $3
a square foot,
QAA. The
offer which the letter under
acknowledgement leaves
in abeyance. It should,
however, not be overlooked
that the legal estate
in the land is vested
in the Crown, but as
it follows that apart from any
authority Her Majesty has given
to the Governor power,
in common with other Crown Land,
to dispose of it, the
land virtually belongs
to the Colony subject
to its occupation by
the military authorities,
and if that occupation
ceases, the power of
the Governor to sell
the land for the benefit
of the Colony becomes absolute
and complete. The Colony,
therefore, has rights
which cannot but be
of considerable value
