It is great for the 339 square feet, which you say is the difference between the area mentioned in his lease and that of which he is actually in possession, informed that there is a very full market value for the land in question. I am to inform you, therefore, that upon your surrendering Mr. Stephen's Crown Lease, a new and corrected one will be issued to him, the Crown Rent being calculated on the actual area of the lot, and that you will be at the same time paid $1700 for the 339 square feet in question.
If you decline this offer, the sum in question will be placed to Mr. Stephen's credit, and the rent due from him will, from time to time, be taken from it, until the amount is exhausted. On the latter event happening, if the rent be not thenceforward paid, the Government will be compelled to exercise its right of entry into the lot in question.
His Excellency much regrets that what he feels justified in conceding should fall so far short of what you appear to regard as right, but, with an anxious desire to mete out the strictest justice in the matter, as the guardian of the public purse, he is unable to take into consideration the consequences of Mr. Stephen's ill-advised proceedings.
