I did not gather from the Secretary of State's letter of the 29th September to Mr Stephens that he had decided that Mr Stephens was not entitled to any compensation, but simply that he did not then perceive that he was so entitled in connection with legal proceedings or the consequences thereof, but deficiency in area would afford ground for settlement in such and way as may be just;

I apprehend if it can be shown for reason that by reason of Mr. Stephens having been put into possession of this Lot by one department of the Government and his implicit faith in the correctness of the Crown Lease granted to him; while another, the Judicial department, has since taken a portion of it away in error, contrary to their own decree, His Excellency the Governor will be justified by the Secretary of State's direction in ordering an adequate compensation for the damage and pecuniary loss sustaining Mr Stephens, in accordance with what I conceive to be the tenor of the Secretary of State's letter.
