Opinion of the Acting Attorney General.
338
I asked for these papers in order to submit to E. the AAG. some observations respecting certain remarks made by Magistrate Mitchell-Innes as reported in the China Mail of the 9th instant, saying:
It was the opinion of the "Acting Governor that after the original warrant had been granted the case would have to be proceeded with in the ordinary way.
His Worship had also got the opinion of the Acting Attorney General that the warrant was perfectly valid: That being so, the only thing his Worship could do was to proceed with the case.
I submit that the Magistrate was wrong in making these statements: Besides being irregular they tend to create a belief in the public that the Government or the Attorney General interferes.
