Dee Wong says positively he never saw a Justice official or had any trouble with them until the 21st June. Then he never made any report of this burglary or of the prisoner having taken part in it to anyone. Sheran Shap Yi says he never made a report or said a word to anyone about it. And yet the only people, according to the evidence, can identify the prisoner as having taken part in the burglary although living far apart in a country where communication is so slow.
They are then kept for four or five days in Hong Kong by the prosecutor before being formally taken with the goods to speak as to the identity of the prisoner.
With reference to the identification of the prisoner, putting aside for the present the evidence of the alleged accomplice Lee Foon, we draw His Excellency's attention to what it really is. In fact, it is the whole of this direct evidence (with the exception of Lee Foon's) against the prisoner. It is as follows, quoting our note made at the hearing: Swan Phap says, "I see the prisoner was one of those keeping guard over me. He had a black woollen jacket, black trousers, and cloth upside down that night."
In cross-examination - "I don't know defendant, I never knew his name or saw his face until..."
