"As the P. C. corner of the dwellinghouse on MacDonald's Slip has been pulled down Mr. Vanby could not by measuring 2 feet 8 inches from there show me the point required but he informed me that at the time he took that measurement he also made a private measurement from that point to a black line on a wall running along the south of Lot 38 and found that the point fixed by him was 1 feet 1/2 inch from that black line. This black line is still in existence and by means of it Mr Vanby fixed the point which he states forms the South Western extremity of Lot 38 and consequently the Southern extremity of the line of boundary laid down by him in 1844, and confirmed in 1880 between Lots 185 and 38 and Lot 184.
Mr Price then stated that according to Mr. Canby's own calculations the Southern extremity of the boundary line could not come where he (Mr Vanby) had placed it for the following reasons:
Although the S. E. corner of the dwellinghouse on MacDonald's Slip is not in existence at the present time, yet if there is only a piece of about ... carried on in a straight line, as the plan indicates, until it meets the Southern boundary of lot 1844 and that then 2 feet 8 inches is measured to the Eastwards as Mr Tuby states, it will bring you to a point about 10 inches East of Mr. Canby's point, and this appears to be the case. Mr. Price further states that the only way to make the points agree is to suppose that the existing wall of the dwellinghouse instead of continuing in a straight line sheered off sufficiently to the Westwards to account for the discrepancy of about 10 inches, which Mr. Price says is a most improbable supposition; Mr. Canby states in reply, as I understand him, that whatever was the exact position of the corner of the dwellinghouse on MacDonald's Slip, yet at any rate he measured from that corner a distance of 2 feet 8 inches and found a point ... inch distant from the existing black line and that point he says is the true Southern extremity of the boundary between Lots 185 and 38 and Lot 1841 laid down by him in 1844 and confirmed in 1880.
As a further proof of the accuracy of the point as fixed by him Mr. Vanby says that from the black line now in existence he measured eastwards 59 feet 1/2 inch to ...
