is of opinion
that this 2nd Article of the
Treaty of
Tientsin
is a
Complete Treaty. His Excellency is advised that
you
are not correct in
stating that it is extremely doubtful whether Ordinance
of
1850 and 2
of 1871 apply
in these cases, as
Ordinance
the latter
has removed all
doubt in the matter.
His Excellency believes that he is
bound to deliver
over
Leung
as if the Magistrate has
found
prima facie
sufficient grounds to
justify the Governor in Council
differing from the Magistrate.
As the case has not yet been considered by His
Excellency in Council, he is not able to say what his decision will be, but His Excellency feels
that he is bound to give due weight to the decision of the Magistrate, who has found a prima facie case
against the prisoner
