Lieutenant Harris has shown

addressed to him, stating

that you have no power to convict in the referred to; under the Statutes in force

in the Colony,

and I have seen the

Commodore on the subject.

By his desire & request

I remand the prisoner, and give

official from the

convicting,

in order that

you

will

put the case before H. E. the Governor.

The Statutes 16+17 Vict

are

against boarding; and

hovering, or bringing spirits

make no mention of payment

or consideration.

If the charge

was wrongly framed,

I proceed again under the above.
