22. That this was the 5th November he requested by the Acting Colonial Secretary,

on the 6th November he was ordered by the Officer Administering the Government

to return to do legal work temporarily

23. That Dr Wharry was not satisfied with his defence and had been put on for explanation;

if temporarily during the illness of the head he had exceeded his duty for insubordination and disobedience

on the 18th

On the 16th he again had opportunity of obeying the orders that had been given

it was open to the Governor to issue a positive order.

24. That Dr Wharry received and again refused on the 20th

the inference was that his explanations were not satisfactory, and he was further charged formally on the 8th instant.
