(d) to be fixed by the said Court and proffer his claim to the amount in Court.
That in the event of no such person appearing within the time so to be fixed that the said property should be sold and the proceeds, less the costs, should be paid into Court to the credit of the said Information and Suit and to abide further Order of the Court.
#On the 12th day of May in the said year 1885 that the said sum of $7374.54 standing to the credit of Wong Acheong be paid out and the same was accordingly paid out to your Petitioner.
"That $2220 portion of the said sum paid into the said Court on or about the 12th May 1865 in pursuance of an Order of that date, and $3609.54 further portion of the said sum paid into the said Court on the 5th August 1868.
While fully belonging to your Petitioner, was until recently granted in terms of the prayer of the said Petition and fixed three months as the time within which the said Wong et Cheong could come forward and substantiate his claim to the said rent and premises.
The said property was sold by public auction on the 10th day of July in the year 1868 when one Pangetyin was declared to be the highest bidder "On the 11th day of December 1868 an Order was made by the Supreme Court vesting the said property in the said Pangetyin.
A sum of $3694.75 was paid into Court as net proceeds of the said sale, and a sum $3679.79 was received for rents.
On the 12th November 1884 your Petitioner applied to the said Court for payment of the said sums of $3694.75 and $3679.79 making an aggregate total of $7,374.54, the amount so received and paid in as aforesaid, and enquiries having been made, and on supplying the necessary evidence, your Petitioner was paid.
Your Petitioner was aware that certain property had been sold, but in total ignorance as to what had been done with the proceeds of sale, that was the sole reason for not applying for payment earlier.
Your Petitioner has ascertained through inquiries that all money, so paid into Court aforesaid, is paid into some Bank on current account, and interest received thereon.
Through no fault of your Petitioner, he never received the said sum of $7,374.54 till the said 24 March 1885, and from the said 12th May 1865 and the 5th August 1868 the said sums of $2220 and $3609.54 respectively earned interest, which was received by the Government of Hongkong, and to which your Petitioner humbly submits he is justly entitled, though his application for the same to His Excellency the Officer Administering the Government of Hong Kong has been refused.
