The maximum penalty provided by the law is $200 fine and in default of payment, imprisonment with or without hard labour for a period not exceeding six months. The Magistrate was satisfied that the men had been identified, and he considered the case so serious that he ought to forward it to be dealt with by the Supreme Court in Criminal Sessions.
Yet, when the case is remitted back to him, he imposed a penalty less than one-sixth of the maximum permitted by the law.
