The question raised is whether Mr Marsh can have a pension based on his final salary for his whole term of Service. Mauritius and Hongkong being treated as one Scheme, he can be given this.
The colony charter he must (Act of 1869): the question is whether there should be two separate pensions according to the salaries drawn in the two colonies.
This is under the Scheme of 1870!
Under the former case he would of course get much more than in the latter. His case is not parallel to Sir C. Smith's: Sir C. Smith was refused the benefit of the 1869 Scheme because he was moved from Hongkong where it had been adopted though not finally approved, to the Straits
