Mr. Cecil L. Smith in

a report dated 15th May, 1878,

says

It is

a well known rule

of the market

that when

a stall falls vacant it is

put up to tender

and

Governor Stewart

asking the

question when

Stall reverts to Government has often arisen, and

it seems to have been the

invariable rule to hold that

they did so revert and

pass to

(my emphasis)

the representatives of the deceased have always petitioned the Government

to allow them to continue,

sometimes they have been

allowed to do so on

paying a premium, sometimes under special circumstances they have been admitted without

any payment, and at other times the Stall has been put

up for sale.

The question when the holder of

a stall dies leaving a

wife and

child who desire to carry

on the business is that regarded

as vacant? M. Smith answers, "That in the contingency

given

the Stall would still be held

to be vacant,"

Gerard, who was

Acting Registrar

General in December, 1878, (CSO2798) it will be

seen that it

was held that on the death

of the Lessee

the Stall reverted

to Government.
