Lan, and the opinion was that the Government was not so committed. The Executive Council then animously recommended that the opinion of the acting Attorney General should be adopted. Accordingly, Chi Ham Fong has been ejected, and he now prays Your Lordship to order that he be reinstated.

I would call Your Lordship's attention to the fact that in his memorial he offers to pay such rent as may be deemed equitable. Had he been very sure of his position, he would have insisted on being reinstated at the rent formerly paid, and would have entered an action against Government to enforce his claim. Apparently he has been advised that such a course would be attended with doubtful success, and he has preferred to appeal to Your Lordship.

Throughout this matter the Government has acted in accordance with the advice of its Law
