I would not have memorialised Your Lordship on the matter did I not consider it the keynote of somewhat important proceedings which I am informed will be brought before Your Lordship's notice.
3. The opinion conveyed to me in the above quoted letter appears to be divisible into three separate matters -
(a) That the Captains Superintendent should investigate all complaints of misconduct against a Constable. complaints by the Public the Captain Superintendent is to investigate but should it ...a matter in which he is to interfere, he is to explain the matter and allow the complainants to proceed as they think best.
(b) That it is the duty of the Captain Superintendent to enquire into charges of Larceny, Bribery, allowing a prisoner to escape and gross misconduct in a member of the Police Force (a) entirely with the reservation that I cannot dismiss a Constable for misconduct, unless he has heard the evidence against him and had an opportunity ... the witnesses.
6. I understood the main object of the Government to be the facilitation of hearing. I fail to see how a double hearing will assist in that respect. that So especially cited by the Acting Attorney...
