(a) to the time which has elapsed (6 years) since the commission of the alleged Crime and the demand for extradition,

(b) to the fact that the acts of piracy with which this prisoner, Cheung a chi, as well as Cha chi are charged were committed in the close neighbourhood of Ling Hoi, and that both accused reside and have resided for many years at their native village, Joha Kio, Kinghoi, which is near.

(C) that they both reside, or are to be found, in the neighbourhood of their alleged crimes for some years after committing them, yet it is only when they are engaged in the salt trade (? smuggling) between Hong Kong and some Chinese ports that their rendition is demanded,

(d) that instead of hiding himself, the accused voluntarily appeared every day in the Police Court during the examination in the case of Cheung a chi, and was only arrested after evidence had been given, which evidence was in his favour.
