278 reported that he had sent the prisoner back to Gaol to await my orders, on the grounds that it was his duty, however slight a prima facie case had been made out against the prisoner, no matter how it was made out, and positive evidence negativing it produced for the defence, this only course under such circumstances was to remit the prisoner to Gaol!
